Liability and Warranty for DC Products

WARRANTY AND LIMITED LIABILITY CLAUSES TO INSERT INTO MANUAL

This document contains instructions specific to this product and should not be used with any other products. Prior to installation or use of this product, review this manual carefully and consult with a licensed contractor, certified electrician, or qualified installation professional to ensure compliance with local laws, including, but not limited to, building codes, by-laws and applicable regulations.

It is your responsibility as the user of the product to:

  1. Consult with a certified electrician to ensure the safe installation and use of this product.
  2. Verify that both the materials used and the installation procedures follow local laws, including, but not limited to, building codes, by-laws and applicable regulations. 
  3. Follow all instructions for installation, operation and maintenance.

PRECAUTIONS:

When using electrical products, including this product, you as the user should always follow these precautions:

  1. Carefully review all instructions prior to using this product.
  2. This product is not intended for use by children.
  3. Avoid inserting fingers, foreign objects or sharp metallic objects, such as wires, tools, or needles into the EV connector.
  4. Never touch live electrical components.
  5. Do not use this product if the power cord or EV cable exhibits wear, broken or torn insulation, or any other visible signs of damage.
  6. Do not use this product if the attachment or the EV connector is defective, broken, cracked, frayed, open, fails to operate or displays any other indications of damage.
  7. To prevent the risk of fire or electric shock, refrain from using this product with an extension cord or electrical adaptor.
  8. Incorrectly connecting the equipment grounding conductor can pose a risk of electric shock. If uncertain about proper connection and grounding, consult a certified electrician for clarification.
  9. Periodically inspect the product to ensure that all parts remain in good working order and there is no damage to any parts.
  10. Do not open, disassemble, repair, tamper with, or modify any components of the product.
  11. Do not install this product near flammable, explosive, harsh, or combustible materials, chemicals, or vapors.
  12. Turn off power at the circuit breaker before installing or cleaning product.
  13. Use the product only within specific operating limitations. 
  14. Incorrect installation of the product could potentially damage the product and components.

 

LIMITED PRODUCT WARRANTY

[Product Name (DC chargers)] (“Product”) AND  -YEAR LIMITED PRODUCT WARRANTY (“Warranty Period”)    

This warranty is extended by Soneil International Limited (“we”, “us”, “our”) to original purchases of [Product Name] through us or authorized sellers. We warrant the following:

  1. This Product is free from defects in materials and from defects in workmanship for the Warranty Period specified above, starting from the date of purchase.

Under no circumstances will the Warranty Period be extended as a result of your Product being repaired or replaced. THIS WARRANTY MAY ONLY BE USED ONCE PER PRODUCT. 

If, within the Warranty Period and under normal operating conditions, your Product becomes defective, provide written notice of the defect to us by email at [contactus@soneilspark.com] with the subject line ‘WARRANTY’. You will need to provide us with your name, email address, mailing address, Product Model Number, Product Serial Number and a detailed description of the problems you are experiencing with the Product. 

Upon receipt of the written notice, we will determine in our sole discretion, the validity of any such warranty claim. You must produce the original purchase invoice/receipt, including the date of purchase. If we determine you qualify under this warranty, we will send to you a return label and instructions on how the product is to be packaged. Upon receipt and review of the defective product, we shall either repair or replace the Product as necessary to remedy the defect. The decision of whether to repair or replace a part or to use a new, reconditioned or remanufactured part will be made by us, at our sole discretion. The replacement may involve the use of similar quality parts, including components from manufactures other than the original, or reconditioned and remanufactured parts as required. Any replacement product will be mailed to you. 

In the event we determine you do not qualify under this warranty; you will be informed of the reasoning behind the decision and presented with available options.

This warranty will apply only if the Product is defective.

This warranty DOES NOT APPLY TO:

  1. Failure to follow the instructions, operation, maintenance, and warnings published in this document and other documents supplied with the Product.
  2. Any damage directly or indirectly caused by, due to, or resulting from, accident, negligence, use, maintenance, storage, transport, lack of or improper installation, or Product being misused, abused, modified or otherwise altered.
  3. Any damage, whether incurred directly or indirectly, caused by, due to, or resulting from, any repair, alteration or modification to the Product or any parts or components, or the installation or use of any parts, components or accessories, performed by an uncertified individual and the use of non-genuine Soneil Spark accessories or parts.
  4. Surface or cosmetic damage or general appearance such as damage to the paint, chips, scratches, dents, cracks or normal aging.
  5. Damage to the Product as a result of an extreme power surge, extreme electromagnetic field, the environment, or any acts of God or nature, including, but not limited to, fire, earthquake, water and lightning.
  6. Any damage caused by external factors, including, but not limited to, faulty or damaged electrical wiring or connections, external electrical faults, junction boxes, circuit breakers, receptables or other power outlets.
  7. If the Product is used with or connected to any extension cords, extension cables or electrical adapters from third-party sources.
  8. Any damage directly or indirectly caused by, due to, or resulting from, normal wear and tear of cables.
  9. Plugs exposed to extreme cold, heat, rain, snow or water for prolonged period of time.
  10. Any damage to any WiFi connected Product caused by any software provider.
  11. Failure to contact us upon discovery of a defect covered by this warranty.

 

This warranty may be voided, or coverage excluded due to lack of or improper maintenance, service or repairs.

We assume no liability for and this warranty does not cover any costs or damages related to dismantling, removal, installation, faulty installation, re-installation, labor, or any consequential damages that may arise.  

EXCEPT AS SPECIFICALLY OUTLINED IN THIS LIMITED PRODUCT WARRANTY, WE DISCLAIM ALL IMPLIED AND EXPRESS WARRANTIES AND CONDITIONS TO THE MAXIMUM EXTENT PERMITTED BY LAW. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY AND NON-INFRIGEMENT, WHETHER EXPRESSED OR IMPLIED, REGARDING THE PRODUCT, THEIR DESIGN, MATERIALS, WORKMANSHIP, LIFE, PERFORMANCE, SUITABILITY, OR THE INFORMATION, SPECIFICATIONS OR MANUALS PROVIDED WITH THEM. 

EXCEPT WHERE SUCH EXCLUSIONS ARE PROHIBITED BY LAW THE PERFORMANCE OF NECESSARY REPAIRS AND/OR REPLACEMENT OF NEW, RECONDITIONED, OR REMANUFACTURED PARTS BY US FOR THE COVERED DEFECTS IS THE EXCLUSIVE REMEDY UNDER THIS WARRANTY.

 

LIMITATION OF LIABILITY

EXCEPT WHERE SUCH EXCLUSIONS ARE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCE WILL WE NOR OUR PARENT, SUBSIDIARIES, AFFILIATES OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, SUCCESSORS OR ASSIGNS BE LIABLE FOR NEGLIGENCE, GROSS NEGLIGENCE, NEGLIGENT MISREPRESENTATION, FUNDAMENTAL BREACH, DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OR DAMAGE TO DATA ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT, LOSS OR DAMAGE TO ANY PROPERTY, LOSS OR DAMAGE CAUSED BY THE CONNECTION OF PRODUCT TO ANY VEHICLE, OTHER DEVICE OR SYSTEM, LOSS OF TIME, PUBLIC TRANSPORTATION FARES, VEHICLE RENTAL, FUEL EXPENSES, CHARGING FEES, LODGING EXPENSES, COSTS OF REPLACEMENT GOODS, DAMAGES RESULTING FROM USE OF OR RELIANCE ON THE INFORMATION PRESENT AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, BREACH OF PRIVACY, BREACH OF WARRANTY OR CONDITION, OR OTHERWISE AT LAW OR IN EQUITY, EVEN IF THE PARTY WAS ALLEGEDLY ADVISED OR HAD REASON TO KNOW, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, OR RELIANCE ON, OUR PRODUCT. 

WITHOUT RESTRICTING THE APPLICABILITY OF THE TERMS AND TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW, OUR LIABILITY REGARDING THE PRODUCT, OUR LIMITED PRODUCT WARRANTY OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT FOR WHICH DAMAGES ARE BEING CLAIMED.
